Payment Terms and Conditions
Sales are final unless applicable law provides otherwise. Products and services are non-refundable, non-exchangeable, and no store credit will be issued. All balances are due at completion. If customer postpones work after the start date but before completion, customer agrees to pay for labor and materials furnished to that point. If work is delayed, the balance for completed work and delivered materials becomes due. A late charge of 1% per month, or the maximum allowed by law, applies to past-due balances. Any credit card supplied may be stored and used to satisfy amounts due. Contractor may suspend work for late payment.
All product remains the contractor’s property until paid in full. Any alteration or deviation involving extra cost will be performed only upon signed change order, and such deviations are an additional charge. Customer shall provide clear access to the work area to avoid delay. Customer is responsible for any damage they cause or conditions they create that impede work. Contractor is not responsible for structural, mechanical, or environmental conditions existing before the work and may halt work if such conditions are found or worsen. Customer is responsible for proper care, cleaning, inspection, and routine maintenance per installation and user manuals; failure to maintain voids warranties and contractor responsibility. Work required to meet code or inspection upgrades beyond the original scope will be billed additionally. Any estimated completion date is approximate and not guaranteed, and delays do not relieve customer of payment obligations.
Natural stone, limestone, brick, and other masonry materials may vary in color, texture, or appearance from samples or representations; such variations are normal and not defects.
All agreements are contingent upon strikes, accidents, weather, or delays beyond contractor’s control. Customer is responsible for permits, bonds, and required approvals unless stated otherwise. Contractor warranties labor on products installed for 1 year. Masonry repairs carry a 2-year warranty unless the liner or surrounding structure is unsatisfactory. Contractor is not liable for service, maintenance, or repairs made by customer or any third party. Contractor’s liability is limited to the contract price and excludes consequential or incidental damages. In any collection or enforcement action, customer is responsible for reasonable attorney’s fees and costs. If any provision of this agreement is unenforceable, the remaining provisions continue in full force. No failure by contractor to enforce any term is a waiver.
